1. Agreement
These Terms govern your use of acquisitionist.world and any services provided by Acquisitionist (“we”, “us”). If you sign a proposal, order form or statement of work (“Order”), that Order and these Terms together form the agreement; the Order wins if they conflict.
2. Services
We provide marketing services that may include strategy, advertising management, content and creative production, AI video and avatar production, search engine optimisation, websites and funnels, CRM and automation setup, AI-assisted lead response and appointment setting, reputation management, outbound lead generation and reporting, as described in your plan (Sterling, Gold Standard, Platinum Dominion) or Order.
Services are delivered by a combination of AI agents and people. We decide the tools, models and methods used, and may change vendors provided the service level doesn't materially decrease.
3. No guaranteed results
Marketing outcomes depend on factors outside our control, including your offer, pricing, market, sales process, platform algorithms and ad policies. Any figures on this website, including case studies and targets, are examples and not promises. We commit to doing the work described, reporting on it transparently and optimising in good faith.
4. Your responsibilities
- Provide accurate information, timely approvals, and access to the accounts and assets we need.
- Ensure you have the rights to all materials, customer lists and data you give us, including valid consent to contact people by SMS, phone or email.
- Ensure your products, services and claims are lawful and substantiated, and comply with advertising platform policies and industry regulations (for example health, finance or legal advertising rules).
- Handle leads and appointments we deliver promptly. Response by your team affects results.
5. AI-generated content and approvals
Content may be created or assisted by AI. We review output before it goes live, and material content is shared with you for approval. Once you approve content, or if you've enabled auto-publishing for a category of content, you accept responsibility for its publication. Tell us promptly of anything inaccurate so we can correct it.
6. Likeness, voice and AI avatars
If we create an AI avatar or voice model of you or your staff, we will only do so with the written consent of each person depicted. The avatar and model are used only for your account and for purposes you approve, are never used for another client, and are deleted on request or at the end of the engagement unless you ask us to hand them over. AI avatar content will be disclosed as AI-generated where the law or platform rules require it.
7. Fees, ad spend and payment
- Plan fees are billed monthly in advance. Setup fees, where applicable, are billed at the start.
- Ad spend is not included and is paid by you directly to the platforms via your own accounts.
- Third-party software used only for your account (for example SMS credits or a dedicated CRM seat) may be billed at cost or paid by you directly.
- Prices are in Australian dollars (AUD) and include GST where applicable.
- Late invoices may pause services after 7 days' notice.
8. Term and cancellation
Plans have an initial 90-day term to build, launch and optimise, then renew month to month. After the initial term, either party may cancel with 30 days' written notice. See our Refunds & Cancellation Policy.
9. Ownership
- Your accounts and data (ad accounts, domain, CRM, analytics, customer data) belong to you at all times.
- Deliverables made specifically for you (ads, copy, pages, videos) transfer to you once the related fees are paid.
- Our tools, including agent configurations, prompts, templates, automations and know-how, remain ours. You receive a licence to use any of them embedded in your deliverables for as long as you use those deliverables.
10. Confidentiality and data protection
Each party keeps the other's confidential information confidential. When we process personal data on your behalf, we do so under our data processing terms and our Privacy Policy.
11. Free automations and resources
Free blueprints, templates and code on this website are provided “as is”, without warranty, for your own use. You are responsible for configuring, testing and operating them lawfully, including consent and opt-out requirements for messaging.
12. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential losses, including lost profits or revenue, and our total liability under the agreement is limited to the fees you paid us in the 3 months before the claim. We are not responsible for actions of advertising platforms, including account suspensions or policy decisions.
13. Website use
Don't misuse the website: no scraping at scale, attempts to break security, or submitting others' information without permission.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of its courts, unless your Order says otherwise. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
15. Changes
We may update these Terms. Changes apply to new Orders and, for existing clients, 30 days after notice.
